Free Trade V.S. Fair Trade

MYTH: The concept of free trade is very appealing in theory. The notion that countries engage in rules-based, free exchange of goods where each trade partner receives fair value.

FACT: In reality, free trade is a myth. Every country imposes tariffs or erects non-tariff trade barriers to gain an economic advantage or protect strategic industries. To protect American jobs, the U.S. government seeks to address these unfair trade practices through anti-dumping (AD) or countervailing duty (CVD) actions.

There are more than 300 AD/CVD import injury investigations listed on the U.S. International Trade Commission website, including Cast Iron Soil Pipe and Cast Iron Soil Pipe Fittings from China.

But satisfaction has been short-lived. Almost immediately following the imposition of these duties, the offending parties started evading them, most notably transshipping products to hide the true country of origin.

What is dumping?

Q: What is dumping?

A: Foreign manufacturers engage in the practice of “dumping” when they export products to the U.S. at prices below the established domestic market price or when they ship excessive quantities of products that cannot be explained by normal market competition. Under the Department of Commerce’s International Trade Administration regulations, U.S. domestic firms may file antidumping petitions claiming that imported goods are priced at “less than fair value.”

The International Trade Commission may find there is “injury” to the U.S. domestic industry and impose “antidumping” duties on imported goods at a percentage rate calculated to counteract the dumping margin. The U.S. Trade Representative monitors trading partners’ activities, enforces U.S. rights under trade agreements, and negotiates and signs trade agreements that advance the President’s trade policy.
